TPS Ended? Save $1000 and File Asylum Now
Persons from Haiti, Venezuela, Nicaragua, and Honduras are having work permits under Temporary Protected Status (TPS) end either this year or early next year. TPS for Honduras and Nicaragua ends September 8, 2025. TPS for Haiti is extended only until February 2026. If your TPS work permit is ending and you can’t go home, file asylum now — or get ready to pay Uncle Sam $1,000 just to stay in line.
Asylum Fees and Work Permit Fees
While the asylum application is in process, the noncitizen gets a work permit. If it is approved, the noncitizen gets a green card – like the one of our client photographed above. Under a new law signed on July 4, 2025, there is a minimum non-waivable $100 fee to file asylum.
To PUNISH asylum seekers for government-imposed processing backlogs that may take 10 years, there are now also additional $100 annual fees for every year a person’s asylum application remains pending. When a new law comes out, most people wait to see what others are going to do before they apply. But here’s what I’ve seen: the ones who file early often get faster processing because the government isn’t getting as many applications yet. If you’re ready to move forward, this could be the best time to act. Filing now could save $1,000 in these yearly fees.
The new law also adds a fee of $550 for the first asylum work permit. EVERY YEAR there is an additional fee of $275 to renew the work permit.
Rubio Tells TPS Holders “File Asylum”
In May 2025, Secretary of State Marco RUBIO said that “many [Venezuelans on TPS], if not most, will have very credible asylum applications.”
Rubio said this because when his president is taking TPS, noncitizens have no choice but to file for asylum if they want to remain in the United States. Without a TPS work permit, thousands are losing their jobs, their homes, and their dignity.
