Congress Created the Immigrant Visa System
In 1924, Congress reshaped the way foreigners are allowed to live and work permanently in the United States (legal permanent residency, known as green cards). Foreigners used to arrive at ports like Ellis Island. Because of security concerns after World War I, Congress made a consular visa system. Today, when a consulate issues an immigrant visa, that acts like a gateway to legal permanent residency. The White House Wants to Stop LEGAL Immigration
If you remember the Schoolhouse Rock video about the division of powers, you know that this administration’s policies stopping LEGAL immigration are unconstitutional. Over and over again, federal judges (the judiciary branch) have ruled that this administration (the executive branch) has overstepped the powers given to the White House by the Constitution. The president hires attorneys who are (as he is fond of saying) losers. Plaintiffs have won against the White House’s policies to stop refugee admissions, diversity visas, birthright citizenship, asylum, and work permits.
State Department Refuses to Publicly Side with White House
The State Department has not explicitly confirmed the processing pause. Instead, the department claims that visa appointments must be rescheduled because State Department employees – even ones with decades of experience – need to undergo “in depth training.”
The Department of State may be refusing to publicly admit to the pause because, unlike the White House, they know that such a worldwide pause is illegal. A federal judge ruled in August 2026 that the administration’s prior visa freeze for citizens of 75 countries was “contrary to law.” State Department officials also know that foreigners may abandon the visa process and move to other countries…taking their tax dollars and the tax dollars of multiple generations of descendants to another country.
