Is My Child a U.S. Citizen?

In several decisions during 2025, the Supreme Court has made the United States less of a safe haven for noncitizens. Blandon Law posted that these changes would be coming. 

Three cases highlight the highest court’s disturbing trend of interpreting the Constitution to claim that it allows for the inhumane treatment of noncitizens. On June 27th, the Supreme Court decided that federal courts CANNOT block Trump’s plan to end birthright citizenship.

Individuals can no longer depend on their constitutional rights. Each noncitizen will need to hire a lawyer to personally defend them and file appeals, sending buckets of sand into the gears of this administration’s deportation machine.

Noncitizens Can Be Kidnapped

On June 23, 2025, as explained by Justice Sotomayor, the Supreme Court ruled to allow “thousands will suffer violence in far-flung locales.”  Noncitizens can be kidnapped from the streets and shipped to countries where they have never been and where they may be killed or tortured. Think countries that accept American taxpayer money in exchange to “disappear” noncitizens received from the United States — Libya, South. Sudan, Ecuador, Cuba. Two things make the Supreme Court decision downright terrifying:

  • The order by the Supreme Court justice was unsigned and unexplained
  • Noncitizens can be kidnapped to their deaths without ever being given notice or an opportunity to contest their removal to that third country

Half a Million Cubans, Haitians, Nicaraguans, and Venezuelans Lose Work Permits

On May 30, 2025, the Supreme Court ended a lower court’s pause on ending parole for Cubans, Haitians, Nicaraguans, and Venezuelans. Soon after, the Department of Homeland Security resumed ending parole for nationals of those countries. CHNV parolees all entered the United States legally. Their work permits — employment authorization documents – also ended automatically, leaving over half a million people in the United States but without permission to end a living.
