How Do I Get Work Permit After Venezuela TPS Ending?

The Supreme Court cleared the way for hundreds of thousands of Venezuelans to lose their legal status in 2025. President Biden granted Venezuelans Temporary Protected Status (TPS) in 2021 and 2023, so ending it is a prime goal for this administration. Because a TPS employment authorization document gives people not only a wage, but also dignity, here are three important tips.

Step One – Stay Updated, One Court Decision Could End Work Permits

Your expert attorney is your best source of immigration news. Rumors that TPS work permits are not valid after April 2025 are false. Instead, the website of the US Citizenship and Immigration Service states that TPS work permits are valid through October 2, 2026.

So, what’s the problem with TPS work permits? That the website also says TPS is extended “under protest”. If the federal court rules in favor of this administration (which could happen at any moment), TPS work permits will be denied and revoked. Pending re-registration applications will also be denied.

Step Two – Asylum Can Get You a Work Permit; Don’t Miss Your Chance

Persons who have a well-founded fear of significant harm in Venezuela on account of their political opinion or membership in a particular social group (example, known dissidents) may be able to get a work permit through asylum instead of TPS. Asylum-based work permits are good for YEARS.

Our laws have exceptions. Asylum has a one-year after arrival deadline, BUT noncitizens MUST file for asylum while in TPS status; they can’t apply after TPS has expired (or the court’s decision has taken it away). Venezuelans can apply for asylum YEARS after they last arrived in the United States.

Venezuelans can also apply for asylum AGAIN if they already applied once, were referred to court, and the Immigration Judge did not decide the case.  If the Immigration Judge dismissed or terminated the case, there’s a process to apply for asylum. So long as asylum is pending, a noncitizen can get a work permit.

Step Three – Include Unmarried Children under 21

Children can apply for asylum on their own or as dependents on the asylum application of a parent. Each child (unmarried person under 21 years of age or with their own case) gets a work permit while asylum is pending.
