Twice as Difficult to Get a Green Card For Those Marrying After a Notice to Appear
If you get married after receiving a Notice to Appear (NTA) in immigration court, the rules are tougher. Normally, when your spouse files an I-130, Petition for Alien Noncitizen, they just need to show proof that the marriage is real — things like photos, bills with both your names, and a lease or mortgage you share. But if the marriage started after court proceedings began, you have to show extra-strong evidence that your marriage is truly about building a life together – certificates of children you have together or joint accounts with large amounts in them. It’s not that your case can’t be approved, but the judge will demand undeniable proof.
In Immigration Court, the Deportation Decision Comes within Months
In a memo issued September 12, 2025, this administration gave Immigration Judges an order: issue a deportation order (or approval) or get fired. The memo explained that dangerous noncitizen criminals are NOT the priority for deportation, as they were under Presidents Obama and Biden. Now, priority is given to end the immigration court cases of detained noncitizens with 60 days and to end the cases of those not detained within 365 days of filing of the Notice to Appear. Because the NTA is filed a few months before the first hearing, this new memo demands that Immigration Judges write a deportation (or approval) order within months of the first hearing.
Under the section “Immigration Court Performance Metrics,” the memo threatens that Immigration Judges who do not issue a deportation order or approval in a few months will be dealt with “other relevant action” – meaning, fired or forced to resign.
