Can I Go to my I-130 interview?
Foreigners are being detained at interviews of US Citizenship & Immigration Service. Raul has DACA and no arrests but was afraid to go to his August 13th interview because the day before other persons with DACA and no arrests were detained at that USCIS office and sent to the Everglades facility (known as Alligator Alcatraz). He was told he had to appear “even if he was afraid.” All went well for Raul, and he was approved.
Although you are trying to start a new beginning with a green card, this administration wants to deport as many foreigners as possible – even if they did “everything right,” entered legally and have work permits.
USCIS is the New ICE Police
A fascist leader gives police powers to loyalists. This new administration appointed someone who turned around and gave police power in May 2025 to the director of the US Citizenship and Immigration Services. The US Immigration and Customs Enforcement (ICE) and US Customs and Border Protection already have these powers. Now, the same agency that scheduled interviews for family-based petitions has the power to:
- Order expedited removal
- Issue orders of arrest and removal
- Arrest noncitizens AT THE INTERVIEWS AND WITHOUT WARNING
Blandon Law no longer advising all noncitizens go to interviews at USCIS. Each case is different, and some noncitizens are more at risk than others. Each client must speak with our attorneys separately.
Noncitizens Put in Deportation for “Doing the Right Thing”
In August 2025, as part of its new police powers, USCIS also began putting noncitizens in deportation proceedings after I-130 denials. Although a noncitizen may obtain legal permanent residency green cards after entering the U.S. without permission, the new policy falsely claims that these noncitizens can be deported.
Given these aggressive policies, some of which are illegal, Blandon Law is helping families in new ways – including a deportation preparedness plan.
