Administrative Closed? Danger – You Could Get Deported

Just because your immigration court case was “administratively closed” doesn’t mean it’s over. Thousands of cases are going to be reopened this year – and if those noncitizens don’t show up to their new court date, the Immigration Judge will order them deported without being there. Here’s what you need to know if you or a friend has an administrative closed case.

What?

Immigration Judges administrative close cases that can be fixed by USCIS, the federal immigration agency. Until now, if USCIS had an application – for Violence Against Women Act or U Visa cases, as examples – pending, the deportation process would be temporarily paused. No removal hearings, giving the agency time to decide whether a noncitizen deserved to get a green card. Until now, after USCIS approved the application, the noncitizen would ask for the court case to be reopened and terminated (finished). Or, if USCIS denied the application, the government attorneys would ask for the court case to be reopened to continue with the deportation hearings.

When?

THE CHANGE — the new administration is ordering government attorneys not to wait for USCIS and ordering Immigration Judges to issue deportation orders. By July 9, 2025, ICE’s Office of the Principal Legal Advisor (OPLA) will begin filing motions to re-calendar cases that are administratively closed. The Immigration Judges will then grant those motions by issuing an order that includes a date for a new hearing at court.

How Will Noncitizens Be Deported?

The orders will be MAILED to the noncitizen’s address on file. Meaning, if the case was closed in 2016, the Judge’s order with a date for a new hearing will be mailed to the address the noncitizen gave in 2016. If they don’t appear for the hearing, the Immigration Judge will order deportation!
