I Didn’t Get I-589 Asylum Interview Notice. What Can I Do?

US Citizenship & Immigration Services is trying to trick asylum applicants to miss their interviews. Until recently, when USCIS scheduled an I-589 asylum interview, this update would appear in multiple places. First, the notice itself would appear in the “Notices” tab. Additionally, USCIS would update their Case Status website. This would also prompt an update to the “Case History” tab. Under that former process, anyone who filed I-589 asylum online could comfortably rely on checking only the “Case Status” website OR the “Case Status” tab of the USCIS account.

USCIS is NOT updating the Case Status

USCIS is now only uploading the letter with the date and time of the I-589 asylum interview to the “Notices” tab of the online accounts. Anyone checking only the case status may miss the asylum interview because they won’t see the letter AND won’t receive one in the mail.

If You Filed Asylum Online, Check Back Often

You are your best advocate. If you filed I-589 asylum online, check the “Notices” tab of your myUSCIS online filing account regularly (at least once per week).

Keep the Evidence and Call Blandon Law

If you discover a missed interview notice after the interview has passed, do the following:

  • Take a screenshot of each tab, INCLUDING the date that tab was most recently updated.
  • Also check the USCIS Case Status Online and take a screenshot of the status listed. This will help show that the Case Status does not say “Interview Scheduled”.
  • Call Blandon Law so we can request a rescheduling of your interview or, at the very least, argue that you were never provided with adequate notice of the interview.

Given this administration’s hostile policies with asylum applicants, some of which are illegal, Blandon Law is creatively helping families – including by filing separate asylum applications for spouses and grown children, if they are in danger upon return to the home country.
