
Can I-360 Approval Help My Children?

The client whose approval notice is shown above won Violence Against Women Act, VAWA, not only for herself but also for her two minor children. VAWA is a way for a noncitizen – and their children – to get legal status even if they entered the United States without permission or overstayed their visa.
Children Can Get a Work Permit
Each child of a person who gets a VAWA approval can get an employment authorization document. A work permit provides (1) a Social Security number, (2) proof of legal stay in the country if anyone asks for it, and (3) a driver’s license in some states.
Children Won’t Be Deported
The most important benefit is that the children will not be deported if the parent gets VAWA approval. Because each case is different, it is important for survivors of abuse (by a US citizen or legal resident adult child, spouse, or parent) to talk with an immigration attorney if these survivors have children under the age of 21.
A classic example is a US citizen spouse who abuses a noncitizen spouse and refuses to petition the noncitizen’s biological child for a green card. Even without the stepparent’s help, that child will get a work permit.
Children Will Get Green Cards
Happily, children of VAWA survivors will one day get their own green cards. If they are under 21 and unmarried, they might be able to get a green card (legal permanent residency) immediately through the parent’s VAWA application. But even if they are older or married, the approval of the parent’s VAWA case will put the child on a path to a green card.
