How Long Does It Take to Get Parole in Place 2024 Approved?

On August 19, 2024, US Citizenship and Immigration Services (USCIS) began receiving and APPROVING parole in place. Those luck immigrant spouses of US citizens — who have lived and worked in this country for over 10 years — did not have to risk leaving their families to get a green card.

On August 27, 2024, a federal judge halted the program so USCIS cannot approve more parole in place applications. That judge was appointed to his position by the Donald Trump White House.

How Soon Before Parole in Place Starts Again?

USCIS is still accepting Biden Parole in Place 2024 applications. The federal judge is saying, “Stop everything, let’s take a closer look.” The order is temporary, meaning it’s not meant to last forever. The immigration program can restart once another court decides it’s okay to continue. This might happen in a few days, weeks, or even months. It all depends on how quickly the legal process moves. President Biden’s White House will go to court, argue their case, and wait for the judge to either lift the order or make a different ruling.

So, how soon the program can start again depends on how fast the court handles the situation and whether the judge decides it’s safe or legal to go forward.

What Should I Do if Granted Parole in Place?

The goal is for the Parole in Place decisions to start again. If USCIS approves the parole in place, immigrants will be considered to have entered legally even if Biden’s parole in place strategy is ended by a judge or a future president. This is the #1 reason anyone who entered the U.S. without permission before June 2014 and married an American before June 2024 MUST apply for Biden Parole in Place 2024 NOW, while USCIS is still accepting applications.

How Do I Get a Green Card with Parole in Place?

After USCIS approves the parole application, the U.S spouse can file Form I-130 and the noncitizen can file for a green card (Form I-485). There are many additional forms which must be sent with those two. At Blandon Law, we have been helping families understand those forms and the marriage-based green card process for over 20 years. Let us help you.

While waiting for the green card, the immigrant will get these other benefits:

  • a work permit
  • a Social Security number
  • a driver’s license (in most states)
