Should I Apply for Parole in Place Before the Election?

Those who came into the United States without permission before June 2014 and married an American citizen before June 2024 can now get a green card WITHOUT leaving the United States. They don’t have to apply for Provisional Waiver; they don’t have to risk not being allowed back to their families.

Biden’s Parole Gives Legal Status Even if Ended by Another President

Based on our experience with President Obama’s DACA, we project that the forms for President Biden’s Parole in Place will be out in August 2024. That application — and documents proving that the person has lived in the U.S. since June 2014 – are sent to the U.S. Citizenship and Immigration Service (USCIS).  It’s only a guess how long USCIS will take to approve the parole application, but when they do it counts as if the noncitizen entered the country legally. Being a parolee is the same as having been allowed into the U.S. with a visa. In other words, a Mexican who crossed the southern border without permission in May 2014, married an American in 2019, and was granted Biden’s parole in 2024 entered the U.S. LEGALLY.

Importantly, after USCIS approves the application, they are considered to have entered legally even if Biden’s parole in place is struck down by a judge or is ended by a future president. This is the #1 reason anyone who entered the U.S. without permission before June 2014 and married an American before June 2024 MUST apply for Biden’s Parole NOW.

How Do I Get a Green Card with Parole in Place?

After USCIS approves the parole application, the American spouse can file a petition (Form I-130) and the noncitizen can file for a green card (Form I-485).
